Privacy policy

Our commitment

Bradshaws is committed to providing our customers with exceptional service. As providing this service involves the collection, use and disclosure of some personal information about our customers, protecting their personal information is one of our highest priorities.

We will inform our customers of why and how we collect, use and disclose their personal information, obtain their consent where required, and only handle their personal information in a manner that a reasonable person would consider appropriate in the circumstances.

Our privacy commitment includes ensuring the accuracy, confidentiality, and security of our customers' personal information, and allowing our customers to request access to, and correction of, their personal information.

Definitions

Personal Information means information about an identifiable individual, including name, home address, phone number and email address. Personal information does not include contact information as described below.

Contact Information means information that would enable an individual to be contacted at a place of business, including name, position or title, business telephone number, business address, business email or business fax number. Contact information is not covered by this policy.

Privacy Officer means the individual designated responsibility for ensuring that Bradshaws complies with this policy and applicable privacy legislation.

1 — Collecting personal information

Unless the purposes for collecting personal information are obvious and the customer voluntarily provides it for those purposes, we will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.

We will only collect customer information necessary to fulfil the following purposes:

  • To complete a sale or transaction
  • For marketing purposes
  • To provide customer service
  • To administer a loyalty programme
  • Credit verification
  • To verify identity
  • To identify customer preferences
  • To deliver requested products
  • To provide a warranty or process a return of merchandise
  • To provide a special order of merchandise
  • To administer a complaint
  • To enrol a customer in an event or contest, or administer a survey
  • To ensure a high standard of service to our customers
  • To meet regulatory requirements

For any or all of the above we may request or use your name, address, postal code, phone number, email address, payment card number and expiry date, customer satisfaction information, opinions about products or services, and video security recordings.

2 — Shopping on this website

When you place an order, create an account, or contact us through bradshaws.ca or bradshawscanada.com, we collect necessary information needed to process and deliver your order — your name, delivery and billing addresses, email address, phone number, and payment details.

Payment card details are processed securely by our payment provider. We do not store full card numbers.

Our website is hosted by Shopify, which processes order and customer data on our behalf in order to run the store. Like most websites, ours uses cookies to keep your cart working, remember your preferences, and help us understand how the site is used.

Most browsers accept cookies automatically, but you can set yours to remove or reject them. Some parts of the site may not work properly if you do.

3 — Consent

We will obtain customer consent to collect, use or disclose personal information, except where we are authorized to do so without consent.

Consent can be provided in writing, orally, or electronically, or it can be implied where the purpose would be considered obvious and the customer voluntarily provides the information for that purpose.

Consent may also be implied where a customer is given notice and a reasonable opportunity to opt out of their information being used for marketing, and does not opt out.

Subject to certain exceptions, customers may withhold or withdraw consent. A decision to do so may restrict our ability to provide a particular service or product; if so, we will explain the situation to assist the customer in making the decision.

We may collect, use or disclose personal information without knowledge or consent only in limited circumstances:

  • Where permitted or required by law
  • In an emergency threatening an individual's life, health or personal security
  • Where the information is available from a public source
  • Where we require legal advice from a lawyer
  • For the purposes of collecting a debt
  • To protect ourselves from fraud
  • To investigate an anticipated breach of an agreement or a contravention of law

4 — Using and disclosing personal information

We will only use or disclose customer personal information where necessary to fulfil the purposes identified at collection, or for a reasonably related purpose such as conducting customer surveys, or contacting customers about products and services that may be of interest.

We will not use or disclose personal information for any additional purpose without consent.

We will not sell customer lists or share personal information with other parties.

5 — Retaining personal information

If we use personal information to make a decision that directly affects a customer, we will retain that information for at least one year so the customer has a reasonable opportunity to request access to it.

Otherwise, we retain personal information only as long as necessary to fulfil the identified purposes or a legal or business purpose.

6 — Ensuring accuracy

We will make reasonable efforts to ensure that personal information is accurate and complete where it may be used to make a decision about a customer.

Customers may request correction of their personal information at any time.

7 — Securing personal information

We are committed to protecting personal information from unauthorised access, collection, use, disclosure, copying, modification or disposal.

Our measures include restricting employee access to sensitive information, user IDs and passwords, encryption, firewalls, secure electronic storage, time-limited paper files destroyed under verified certificate of destruction, restricted storage areas, and an alarm system.

When destroying personal information we use appropriate measures such as professional shredding with a certificate of destruction, and deletion of electronically stored information.

We continually review and update our security policies and controls as technology changes.

8 — Access to your personal information

Customers have a right to access their personal information, subject to limited exceptions.

A request must be made in writing to the Privacy Officer with sufficient detail to identify the information sought. On request we will also tell customers how their information is used and to whom it has been disclosed.

We will make the requested information available within 30 business days, or provide written notice of an extension where more time is required.

If a request is refused in whole or in part, we will notify the customer in writing with reasons and the recourse available to them.

9 — Questions and complaints

The Privacy Officer is responsible for ensuring Bradshaw's compliance with this policy and applicable privacy legislation.
